2009-02-02 : OUTCOME PATENT COURT CASE

Court rules: Pelican’s Smartflow does not infringe patent.

The Netherlands, Heinenoord, - February 2, 2009: Pelican Worldwide previously reported that in preliminary injunction proceedings, the Vice-President of the District Court of The Hague ruled on May 30, 2007 that the Pelican Smartflow valve does not infringe the patent of Fort Vale.

After Pelican's victory, FV pursued a case on the merits to the full court.

On January 28, 2009, the specialized patent chamber of the Court of The Hague decided again, that Pelican Worldwide does not infringe the Dutch patent. All claims of FV's patent, which were alleged to be infringed, are found to be invalid.
